Of course thats an edited picture, and Nintendo won't "kick Hori's ass" because of it. Not just that, but its not smbx2 development team's advertisment.
Also, some things:
Not saying anything, but it probably (i don't deny that it probably isn't) was sended by wotjek clone, cause his tag is very suspicious. this dude was sending me a warnings about a safety and all those things, and bossedit8 then told me that it is wotjek (his tag is 8377# ?). So be careful, or if its not dangerous, then have in mind that its fake.

You shouldnt be worried becuase it is unlikely to happen at this time.
The team have also stated on the FAQ section of the SMBX2 blog that if Nintendo does come after them, they plan on replacing all the copyrighted sprites with original sprites. It's bound to happen eventually, and the project won't be quite the same when it does, but at least they'll be able to continue it.

This has been clarified a few times, including on the SMBX2 website. SMBX operates under fair use, as long as Nintendo doesn't complain about us, we'll keep doing what we're doing (and in fact Nintendo's own website states this is their preferred method of operation for fan works like this). If Nintendo decide that what we're doing does not constitute fair use, then we will comply, but as of the moment, there's been no indication that they intend to do this.

It says that the Orakel Boss is only possible in SMBX2, but since it is done using Lunalua its possible in 1.3.0.2.

It is common language to call LunaLua features "SMBX2-exclusive" because 1.3.0.2 is literally LunaLua slammed on 1.3.0.1 through a separate installation. SMBX2 comes with Lua automatically. There's no point with considering 1.3.0.2 a "version".

User-friendliness. It's easier to download the beta 3 package and be done with it than fumble with patching in the correct version of lunalua ontop of a 1.3.0.2 installation. On top of that, it's easier to troubleshoot problems if the developer (I) can assume that everyone is using the same installation.

While i can use the PGE editor, the UI looks more like another program like one of the MS Office programs and it doesnt fit a SMBX editor.
