My friend is in legal trouble, please help.

So two years ago I hit another driver in a moderate car accident in Minnesota because I failed to yield (I was not under the influence). The other driver fled the scene because he did not have insurance on him at the time. Later on I paid my fine and I thought our mutual insurance companies took care of the rest.

So now flash forward to today and apparently the other driver is trying to sue me for $10,000 because of an injury sustained supposedly in that accident. My insurance company is trying to settle with him but the guy's attorney isn't accepting. My insurance company said they will hire and pay an attorney for me if I get summoned to court.

How strong is this guy's case since he fled the scene and possibly aggravated this injury he claims happened in this accident?
Update : Edit: I understand the guy has medical bills but paying him all of that money when he fled the scene is just ridiculous to me.
Update 2: Edit 2: Supposedly his injury is something related to his collar bone....broken or injured or something....
I'm in no way an expert on the law. I don't even have my license yet, but this just doesn't seem right to me. Can anyone give me or him some info on what do do/what to expect? I'm really worried for him.

Technically your friend is at fault since he did fail to yield, so he should have some financial responsibility. However, after two years and such a high expense, I think this one is worth arguing in court for. The other driver left, which is also a violation, since they're both supposed to exchange insurance info at the scene and call the police so stuff like this doesn't happen.

I broke my collar bone the first time around from trampolining myself off of an old couch and landing on a concrete basement floor, and the second time happened shortly after the first, but I only slipped and fell onto the grass, so I probably re-broke it. The expenses for getting an arm sling and x-rays never went over $600 if I recall.

I can see him suing the other guy for around $2,000-3,000 for the auto repairs and medical care, but only if it was a severe case, such as the car getting totaled and the medical conditions were more impairing. A broken collar bone only renders your arm mildly useless, you can still do things with it but it's best if you let it heal in the arm sling without putting too much strain on it. See, if he had injured my spine or given me a concussion/caused me to go unconscious (anything that would require me to have serious medical treatment), I would probably sue him. A broken collar bone isn't really something to get your jimmies rustled over.

The fact that the victim fled the scene and comes back two years later demanding that your friend pays an insanely high fine of $10,000 is just sketchy, and I almost want to say the victim is trying to exploit the system. If anybody is interested, I'd tell you all my parents' wonderful trip to Six Flags New England and the bullshit story the guy tried to tell the judge in court when he totaled my parents' car, he tried to sue a large sum of money claiming to have injuries when he really didn't.

I...would seek legal counsel on matters like these. Look up your state's laws on such matters to educate yourself on the subject of legal liability.

I was going to offer advice, but then I finished reading your post.

It's a shitty guy trying to milk you for cash, who has no reasonable case when you can attest that he fled the scene. Hell, if your insurance country will pony up for a lawyer, then you have your counsel to talk to regarding this legal affair. If you're not paying a dime, then you'll just have to get used to showing up in court for quite a while. It'll be an exercise in professionalism; try to act civil when dealing with this.

In other words: WHY ARE YOU ASKING A COMMUNITY OF CHILDREN ABOUT VERY SERIOUS LAWSUITS NOBODY HAS EVER FACED?!

DO YOU EVEN KNOW WHAT A LAWYER DOES?

At 7 years old, I don't think I would have really known better. Of course now I'm extremely cautious about how I treat myself (as much as I can, really) that I haven't broken anything since I was 7.

If you can,take him to court.
You can also metion to the judge that he fled the crash area.
Im pretty sure that can charge the guy some money,along with the
fact that he dosent have insurence.
But,try to yeild next time.
