One day in the Mushroom Kingdom Mario, Luigi and Peach were having a nice stroll when Bowser attacked them and kidnapped Peach again sending the Mario Bros. underground. Now they must collect the Power Stars to defeat Bowser and save the kingdom

SMBU includes elements from Mario 1,2,3 World And New Super Mario Bros. 9 worlds, bonus stars and more.

It's not like you copyrighted the name, and Super Mario Bros. Ultra isn't that much of a creative name that it's an issue.
