You can always, if you think someone is breaking the rules, click the ! button on the top-right of a post to report it, and give reasons. The staff will then take the appropriate action.
But about the graphic on hand, it looks really similar to the SMB3 one. But considering that SMB2 and SMB3 use similar shades I would say that the SMB3 Podoboo would fit just as well into it than your SMB2 one.

To fit more of an SMB2 feel and make it look considerably different from the SMB3 version, maybe you could try recolouring it with the colours in the lava below it in the screenshot or something similar to that to give it a darker reddish tinge instead of the normal SMB2 colour.
