Also redigit doesn't really care about Smbx anymore tbh. He’s done with it and has way more important things to do.

I advise against it, because if a Fangame gets too much Publicity, Nintendo can't pretend anymore, that they don't see it, following in legal actions.

nintendo can do nothing to smbx. it's a non-profit fangame, and it's not a remake.

Nintendo is well within their rights to request SMBX be taken down. They have not, currently, and seem not to be inclined to, but they are able to make that request should they choose.

SMBX still uses assets from Nintendo IPs (graphics, music etc), and could be viewed as a form of competition with official Nintendo products, especially SMM.

Advertising smbx is absolutely fine - it could only become an issue if big name people started advertising it (since then it would gain a ton of publicity which may cause Nintendo to take action). But normal advertising shouldn't be a problem.

It doesn’t matter if it’s a free game or not, several Mario Fangames that we’re free have been taken down.
Same with Pokémon, Metroid etc. If you use assets made by someone even for a free game you are moving into a grey zone.

That’s pretty much why the original smbx was taken down besides the ads on the site, so I don’t get why you would say Nintendo can’t do nothing when they’ve done it once already.

If they don’t do it, they could loose a lot.

Nintendo isn’t always the bad one when it comes to take down Fangames.

Yeah the url was that and redigit used ads on the site so he gave himself a death sentence.

Smbx can now be view as a competitor to Mario Maker which sold well, not to mention some remakes in Smbx got taken down here already.

Just keep a low profile and you good.
